Terms & Conditions
By browsing www.selectbaits.com and placing an Order, the Customer acknowledges having read, understood and unconditionally accepted these Terms and Conditions.
Select Baits reserves the right to amend these Terms and Conditions at any time without prior notice. In the event of a dispute, the Terms and Conditions in force at the time the Order was placed shall apply.
1. Definitions
User — any person who accesses and browses www.selectbaits.com.
Customer — any natural or legal person who places an Order on www.selectbaits.com.
Seller — SC BIG FISH ARTICOLE DE PESCUIT & NADA SRL (CUI: RO17382878), trading under the brand name Select Baits.
Product — any item available for purchase on www.selectbaits.com.
Order — the electronic document through which the Customer expresses their intention to purchase one or more Products.
Contract — an Order confirmed by the Seller, giving rise to mutual obligations of delivery and payment.
Carrier — the door-to-door courier service provider (DHL, FedEx, UPS, GLS or equivalent) responsible for delivering the Order.
2. Intellectual Property
All content published on www.selectbaits.com — including images, texts, graphics, logos, scripts and design elements — is the exclusive property of Select Baits and its suppliers, and is protected by applicable copyright and intellectual property laws.
Any use of the site's content without the prior written consent of Select Baits is strictly prohibited and may result in legal action.
3. Disclaimer
Select Baits makes reasonable efforts to ensure the accuracy of the information published on the site but does not guarantee the absence of errors, omissions or technical interruptions. Users access and use the site at their own risk.
Stock availability, prices and delivery times are updated automatically and may be subject to change. Select Baits shall not be liable for inaccuracies occurring prior to the email confirmation of Order dispatch.
Select Baits reserves the right to cancel Orders affected by technical pricing or stock errors, with prior notification to the Customer and full reimbursement of any amounts paid, within a maximum of 14 days.
Links to third-party websites are provided solely for the convenience of the User. Select Baits accepts no responsibility for the content of such websites.
4. Pricing and VAT
All prices are displayed in Euro (EUR) and include Romanian VAT (TVA) at the following rates:
11% VAT for the Baits and Attractants category
21% VAT for equipment and all other products
The final amount payable by the Customer consists of the product price plus applicable shipping costs, as detailed in the Shipping section of the site.
Customers outside Romania are responsible for any import duties, customs fees or additional taxes levied by the authorities of their country of destination. Select Baits strongly recommends that international Customers verify applicable regulations before placing an Order.
5. Payment Methods
Select Baits accepts the following payment methods for international orders:
- Credit card (Visa, Mastercard and other major card networks)
- PayPal
Select Baits will never request confidential information, banking credentials or passwords via phone or email. Should the Customer disclose such information to third parties, full responsibility lies with the Customer.
6. Ordering
By completing an Order, the Customer warrants that all data provided is accurate, complete and up to date. Select Baits shall not be liable for delivery delays caused by incorrect information provided by the Customer; any re-delivery costs in such cases shall be borne by the Customer.
An automatic email confirmation is sent upon receipt of the Order. The Contract of sale is deemed concluded at the moment the Customer receives the Order dispatch notification.
Select Baits may refuse an Order, with prior notification to the Customer, in the following circumstances:
Failure or invalidation of the online payment transaction
Non-acceptance of the card by the issuing bank or payment processor
Incomplete or incorrect Customer data
Suspicion of fraud or clearly malicious behaviour
Consecutive failed deliveries attributable to the Customer
Repeated placement and subsequent cancellation or return of Orders
Technical pricing or stock errors
If a Product cannot be delivered, Select Baits will notify the Customer and refund the full amount paid within a maximum of 14 calendar days.
7. Delivery
Select Baits delivers to all European Union member states via door-to-door courier services (DHL, FedEx, UPS, GLS or equivalent). Delivery conditions and rates are detailed in the Shipping section of www.selectbaits.com.
The maximum delivery time is 30 calendar days from the date of Order confirmation. The preparation and dispatch time for each product is specified on the respective product page.
The Customer will be contacted by the Carrier prior to delivery. The Customer is responsible for ensuring they are available to receive the Order at the indicated delivery address; any costs arising from a failed delivery attempt due to the Customer's unavailability shall be borne by the Customer.
Upon receipt of the parcel, the Customer must inspect the packaging and products for any damage and note any issues on the delivery receipt (AWB) before signing. Signing the delivery receipt without objection constitutes confirmation that the Order has been received in full and in good condition.
Important Customs and Import Duties:
Deliveries to EU member states are generally not subject to customs duties within the EU single market. However, any local taxes, fees or charges that may apply in the Customer's country of destination are the sole responsibility of the Customer. Select Baits recommends verifying applicable local regulations before placing an Order.
8. Warranty
Products purchased through www.selectbaits.com are covered by the warranty specified in the product's Warranty Certificate. The legal entity providing the warranty is the one indicated on the Warranty Certificate.
In order to benefit from the warranty, the Customer must:
Have purchased the product from Select Baits and used it solely for its intended purpose
Have followed the manufacturer's instructions for use
Retain the Warranty Certificate and the original proof of purchase
Retain the original packaging and all accessories and return them together with the product
The warranty does not cover:
Mechanical damage, impacts, scratches or signs of improper use
Defects caused by failure to follow the manufacturer's instructions for use, transport or installation
Unauthorised modifications or repairs
Damage caused by external factors: flooding, fire, electrical surges, excessive sun exposure
Products whose serial numbers have been altered or removed
Manufacturing defects will be assessed within a maximum of 30 working days from receipt of the product by the designated service centre. If the defective product cannot be repaired, or if the total downtime within the warranty period exceeds 10% of the warranty duration, the product will be replaced or the Customer will be refunded its full value.
EU Customers benefit from the statutory warranty rights provided by Directive 2019/771/EU on contracts for the sale of goods, which guarantees a minimum two-year warranty period for consumer goods.
9. Returns Policy and Right of Withdrawal
9.1 Right of withdrawal
In accordance with EU Directive 2011/83/EU on consumer rights, the Customer has the right to withdraw from the Contract within 14 calendar days of the date of physical receipt of the product, without being required to provide any justification.
The right of withdrawal does not apply to:
Products made to the Customer's specifications or clearly personalised
Products liable to deteriorate or expire rapidly
Sealed products which are not suitable for return due to health protection or hygiene reasons, if unsealed after delivery
Products which are, after delivery, inseparably mixed with other items by their nature
Digital content not supplied on a tangible medium, where execution has begun with the Customer's prior express consent
9.2 Return procedure
To initiate a return, the Customer must notify Select Baits within a maximum of 14 calendar days of receiving the product, by:

Products must be returned within 14 days of the withdrawal notification, to the following address:

Important:
Returns must be shipped exclusively via a door-to-door courier service (DHL, FedEx, UPS, GLS or equivalent). Standard postal services and EMS are not accepted. All return shipping costs are borne by the Customer.
9.3 Conditions for returned products
Returned products must meet all of the following conditions:
In the same condition as delivered — unused and undamaged
In the original packaging, with all labels intact
Accompanied by all original documents: invoice, warranty certificate, accessories
Select Baits reserves the right to refuse the return of products that do not meet the above conditions or which, by their nature, cannot be resold.
In the case of promotional campaigns that included a free gift, the Customer is required to return the free gift as well, in its original, unsealed condition.
9.4 Refunds
Refunds will be processed within a maximum of 14 calendar days from the date on which Select Baits is informed of the Customer's decision to withdraw. Select Baits may delay the refund until receipt of the returned product or until proof of dispatch is provided.
Refund methods:
Orders paid by credit card — refund to the card used for payment
Orders paid via PayPal — refund to the PayPal account used for payment
Alternatively, at the Customer's request, the refund may be issued as a store credit voucher redeemable on www.selectbaits.com within 30 days of confirmation of receipt of the return.
Original shipping costs are non-refundable unless the return is due to an error on the part of Select Baits or a defective product.
10. Promotional Campaigns and Vouchers
Select Baits may run promotional campaigns, competitions and special offers, the full terms of which are published exclusively on www.selectbaits.com. Promotions are valid while stocks last and within the stated validity period.
General rules applicable to vouchers and promotional codes:
Only one voucher or promotional code may be applied per Order
Vouchers cannot be combined with other promotions or discounts unless expressly stated
Vouchers cannot be converted into cash and cannot be resold
Vouchers cannot be replaced if lost, stolen or damaged
Vouchers are valid exclusively on www.selectbaits.com, within the stated validity period
In the event of a return of a product purchased with a voucher, the discount applied may be deducted from the refund amount
Select Baits reserves the right to modify or discontinue any promotional campaign, with prior public notice through appropriate communication channels.
11. User Account
To create an account on www.selectbaits.com, the User must provide a valid email address and accurate personal information. Select Baits may refuse or suspend an account if false information is provided or if the services are used in a non-compliant manner.
Users are responsible for maintaining the confidentiality of their login credentials. Any activity carried out through a user account is the sole responsibility of the account holder.
12. Fraud
Any attempt at fraud — including but not limited to: creating fake accounts, unauthorised access to other Customers' data, altering the site's content, or using fraudulently obtained payment methods — is strictly prohibited and will be prosecuted in accordance with applicable law.
Select Baits reserves the right to immediately suspend the accounts involved, cancel any related Orders and withdraw any promotional benefits, without notice or compensation, and to report the matter to the competent authorities.
13. Force Majeure
Neither party shall be held liable for the non-performance or delayed performance of its contractual obligations if such non-performance is caused by a force majeure event as defined under applicable Romanian law.
The party invoking force majeure must notify the other party without delay and take all necessary measures to limit the consequences of the event. If the force majeure event persists for more than 15 days, either party may unilaterally terminate the Contract without any claim for damages. Force majeure must be proven in accordance with the law.
14. Disputes and Governing Law
These Terms and Conditions are governed by Romanian law, in accordance with Regulation (EU) No 593/2008 (Rome I) on the law applicable to contractual obligations.
Customers residing in EU member states benefit from the mandatory consumer protection provisions of their country of residence, to the extent that such provisions offer greater protection than Romanian law.
Any dispute will be resolved amicably in the first instance. If amicable resolution is not possible, the dispute will be submitted to mediation, and if mediation fails, to the competent Romanian courts.

15. General Provisions
If any provision of these Terms and Conditions is found to be null or unenforceable, this shall not affect the validity of the remaining provisions, which shall continue in full force and effect.
